COURT CASES

This section is being updated

Project GayRussia.Ru has initiated several claims and court cases over the last months. Any hate speech will systematically follow a request to start a criminal investigation to the General Prosecution of the Russian Federation. Below is a summary of our actions. More details can be found on the site.

Moscow State University : Denial of a "gay topic" for a doctorate (Dec. 01)

The local court denied the claim.

The Moscow Appeal Court rejected the appeal.

Next step : ECHR to accept or deny the case.

Krasnodar : Illegal demonstration aginst the Moscow Pride (Oct. 05)

Request sent to the General Prosecution in Moscow against the hate speech of the organizer of an illegal demonstration held in Krasnodar in October 2005.

Our request was transferred to the Prosecution department of Krasnodar.

The local office answered to us that there was no reason to start a prosecution

The prosecution sent "a warning" to the organizer for breaching the administrative code.

Next step : We will now appeal the decision of the Prosecution not to start a criminal prosecution against the organizer.

Mufti Talgat Tadjudin : Hate speech towards gays in an interview (Feb. 05)

Request sent to the General Prosecution in Moscow against the hate speech of the Mufti.

Our request was transferred to the Prosecution department of Moscow.

The Moscow prosecution answered that the mufti did not breach the law because Koran is a legal document in Russia.

We have appealed against this decision.

The Moscow Prosecution has cancelled the first decision.

Next step : Moscow Prosecution to take a new decision.

Moscow Pride Marche : Denial of Freedom of Assembly (May 05)

The application for the Moscow Pride was denied by the Moscow City Hall.

We have appealed this decision in Court.

The Moscow Court has upheld the decision of the City Hall.

We have appealed this decision.

Our appeal was rejected by teh appeal court.

Next step : Upon receipt of the appeal decision, we will submit the case to the ECHR.

Moscow Pride Picket : Denial of Freedom of Assembly (May 05)

The application for the Picket was denied by the Moscow City Hall.

We have appealed this decision in Court.

The hearing, scheduled on July 19th, was postponed because no representative of the local authorities took part.

The appeal has been rejected.

Next step : Upon receipt of the appeal decision, we will submit the case to the ECHR.
